There are many potential legal issues that arise when working with an ovum (egg) donor, a sperm donor, or an embryo donation. A contract in all of these cases is necessary to address critical issues or parental rights, process and compensation.
When an individual or couple need the services of an ovum (egg) or sperm donor, or will be using donated embryos, I can draft the legal agreement that will detail the parties' rights, obligations, including financial obligations, and expectations. The legal issues regarding identity, confidentiality, parental rights, obligations with respect to future contact and/or medical information, medical expenses, liability for complications to an ovum donor, taxation of monies and the rights of the child will all be addressed.
Note that for surrogacy or donor agreements I will also ensure that your surrogate and/or donor is represented by competent, independent legal counsel, who will be responsible for the review of the agreement as well as for issuing a legal clearance letter indicating that the surrogate (and her husband if she is married) and/or donor understands clearly the issues set forth in the contract, is proceeding with the arrangement voluntarily and without any coercion or undue influence, and is in full agreement with the terms of the agreement.
