For Sperm Donors and Intended Parents:

Let us assist with drafting, negotiating, and/or reviewing your Sperm Donation Agreement

Meryl B. Rosenberg, Esq., and her team are experienced in all aspects of agreements between an individual or couple and a sperm donor. These agreements cover not only financial obligations (if any) and expectations, but also outline parental rights, specify future contact, detail the rights of the child, and even cover things you may not have thought of such as the use of the frozen sperm and disposition of resulting embryos if applicable.

So why is a formal agreement with a sperm donor important? To protect the legal rights of all parties. These agreements create an accurate for-the-record picture of all parties’ intent at the time of the donation, and they ensure all parties have considered every aspect of the sperm donation before the donation occurs.

Specifying future contact with the sperm donor

Some Sperm Donation Agreements specify that the donor will not have contact with the child, or that he may have contact but only with the permission of the legal parents. This agreement is the best way to ensure the intent of the parties is clearly stated and understood.

If you are a same-sex couple you may need added steps to secure your legal rights as parents and to protect those rights.

A warning: There are many generic sample “boilerplate” Sperm Donation Agreements on the internet. It is unwise to use such documents because they are generic, and do not address the individual, specific circumstances of your donation situation. Instead, let Meryl B. Rosenberg and her team help you put together an agreement that works for all concerned — one that serves as both roadmap and protection. As with all our legal work, you can be assured we will always take the time to explain the legal nuances involved.

We are here to help ensure your parental rights are protected and your family-building process is safe and secure.
